🧩 Training Scenario: Misinterpreted Repair Addendum – “Install Sod”

🔹 Scenario Overview
A transaction fell into dispute one day before closing because of confusion surrounding a repair request.
The Repair Addendum included a line item that simply read:
“Install sod.”
No amount, square footage, or area was specified.
The sellers did not install sod, stating that they could not afford the $4,000 cost and that the request was unclear and open-ended. The buyer’s agent later demanded sod installation, while the listing agent had already assumed the issue was resolved.

🔹 What Happened:
The listing agent missed the vague language on the repair request and failed to clarify the scope of work before the sellers signed it.
The sellers then refused to install sod, explaining that:
No specific quantity or area of sod was defined.
The cost was more than they could absorb.
They believed the buyer could accept the property “as-is” without green grass.
The buyer’s agent escalated the issue to the broker because the closing was scheduled for the next day and the repair was considered “agreed upon” in writing.

🔹 Key Mistake:
The listing agent did not review each line item of the repair request in detail before acceptance.
By not confirming or modifying ambiguous language (like “Install sod”), the sellers inadvertently agreed to something undefined — creating confusion, frustration, and last-minute conflict.

🔹 Training Point:
Every line of a Repair Addendum must be reviewed for:
Specificity: Quantities, locations, and clear expectations (e.g., “Install 2 pallets of sod in backyard area disturbed by construction”).
Feasibility: Cost and contractor availability confirmed before signing.
Client Understanding: Sellers must know what they are agreeing to perform or pay for.
If unclear, the listing agent should:
Revise the line for precision, or
Counter with clarification before execution.

🔹 Best Practice Example:
Instead of:
“Install sod.”
It should read:
“Install 2 pallets of St. Augustine sod in backyard area measuring approximately 800 sq. ft., ensuring proper irrigation coverage.”

🔹 Broker Takeaway:
 When reviewing any Repair Addendum:
- Read each line item carefully with your client.
- Clarify ambiguous wording before acceptance.
- Communicate expectations in writing with the cooperating agent.
- Keep documentation of all confirmations and discussions in your transaction file.
