“The Agent Gave Legal Advice Instead of Recommending an Attorney”

🚀 The Scenario
A buyer was under contract and things were moving toward closing.
During the transaction, a legal question came up involving the contract language and potential risk to the buyer.
Instead of recommending the buyer speak with a real estate attorney, the agent said:
“You’ll be fine. That clause won’t affect you.”
Relying on that advice, the buyer moved forward without seeking legal counsel.
Later in the transaction, the issue became very real…
and it cost the buyer money.
Now the buyer was upset and said:
“My agent told me this wouldn’t be a problem.”
The situation escalated…
and now the agent was being blamed for giving incorrect guidance.

This is a hard line agents cannot cross.
Agents are licensed to:
  • facilitate transactions
  • explain contract terms in a general sense
  • guide clients through the process
Agents are NOT licensed attorneys.
That means:
❌ do not interpret legal risk
❌ do not give definitive legal opinions
❌ do not advise clients on legal outcomes
When a situation involves:
  • legal interpretation
  • liability concerns
  • contract disputes
The correct response is simple:
👉 “This is something you should discuss with a real estate attorney.”

What Agents Should Do
Protect your client…and yourself.
✔ explain what the contract says (factually)
✔ identify when something may involve legal risk
✔ recommend an attorney early, not late
✔ document that recommendation
A simple phrase can save you:
👉 “I’m not an attorney, but I recommend you speak with one before making that decision.”

Trying to “help” by giving legal advice is one of the fastest ways to create liability.
