Agent Did WHAT?! The Seller Sold…But Refused to Pay Commission

Agent lists a home, markets it, gets solid activity, and brings a ready, willing, and able buyer. Clean offer, seller signs, everyone’s moving forward.
A few days later…seller starts getting cold feet. Then comes the message:
“I’ve decided not to move forward. I’m just going to keep the house.”
Agent says okay, we’ll get a release signed.
Seller responds…“I’m not paying any commission. The deal didn’t close.”
😬Now we’ve got a situation. Seller thinks no closing = no commission. Agent thinks they did their job and earned it.
And here’s where the contract matters…

🔥 Broker Guidance
• The listing agreement states commission is earned when an agreement to sell is signed, not just at closing
• If the seller refuses to complete the sale, the full commission can still be due
• Many agents incorrectly explain this as “we only get paid at closing”
• That language can come back to bite you HARD
• This is both a legal right and a communication issue

🚨 Action Steps
• Explain upfront when taking the listing when commission is actually earned
• Do not oversimplify it to “we only get paid at closing”
• If seller hesitates during contract phase, remind them of their obligations
• Document all conversations, especially if seller is wavering
• If needed, involve broker early before it escalates

💥 Broker Tip
• The contract protects you…but only if you explained it first
• Most commission disputes are not legal problems…they’re expectation problems
• If this is the first time your seller hears this…you’re already behind
